1. About Our Services

XYRx provides telehealth services that connect patients with licensed healthcare providers for consultations, prescriptions, and ongoing care. Our Services are provided in partnership with OpenLoop Healthcare Partners, PC and its affiliated entities.

State Coverage: Currently offering services in select states. Availability varies by state and may change over time.

2. Eligibility

To use our Services, you must be at least 18 years of age and legally able to enter into a binding contract. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Telehealth Services

Our telehealth services are provided by licensed healthcare providers. By using our Services, you acknowledge and agree that:

  • Telehealth services are not intended to replace in-person medical care for emergencies or conditions requiring physical examination.
  • Our providers may determine that telehealth is not appropriate for your condition and may refer you to in-person care.
  • Prescriptions, if any, are at the sole discretion of the treating provider based on their medical judgment.
  • You must provide accurate and complete health information to receive appropriate care.

5. Partner Pharmacies

Prescriptions may be fulfilled by our partner pharmacies. For a complete list of our partner pharmacies, please visit our Partner Pharmacies page. You may request to use a pharmacy of your choice.

6. Payment and Billing

You agree to pay all fees associated with the Services you use. Payment is due at the time of service unless otherwise specified. We accept major credit cards and other payment methods as indicated on our platform.

7. Privacy

8. Prohibited Conduct

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XYRX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

12. Indemnification

You agree to indemnify and hold harmless XYRx, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services or violation of these Terms.

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.
